1. Agreement to Terms

By accessing or using MotorWorks, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

MotorWorks is provided by Everblue Digital ("we", "our", or "us"), a company registered in Ireland.

2. Description of Service

MotorWorks is a cloud-based garage management software that helps automotive workshops manage jobs, customers, invoicing, and operations. The service is provided on a subscription basis.

3. Account Registration

To use MotorWorks, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised use

You are responsible for all activities that occur under your account.

4. Subscription and Payment

Billing: Subscriptions are billed monthly in advance. You agree to pay all fees associated with your chosen plan.

Plan Changes: You may upgrade or downgrade your plan at any time. Changes take effect at the start of the next billing cycle.

Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. We do not provide refunds for partial months.

5. Your Data

Ownership: You retain ownership of all data you enter into MotorWorks. We do not claim any ownership rights over your content.

Data Export: You may export your data at any time in standard formats (CSV, PDF).

Data Processing: By using our service, you grant us the right to process your data as necessary to provide the service. See our Privacy Policy for details.

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the service
• Interfere with or disrupt the service or servers
• Upload malicious code or content
• Resell or redistribute the service without authorisation
• Use the service to store or process sensitive personal data beyond what's necessary for garage operations

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We will provide reasonable notice for planned maintenance.

8. Limitation of Liability

To the maximum extent permitted by law, MotorWorks and Everblue Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the service. Your continued use of the service after changes constitutes acceptance of the new terms.

10. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.
